Welcome to Phonar! These Terms of Service ("Terms") govern your use of our mobile application (the "App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, please do not download or use our App.
Acceptance of Terms
By using our App, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional terms that may apply.
Eligibility
You must be at least 18 years old to use this App. If you are under 18, you must have the consent of your parent or legal guardian to use the App. By using the App, you represent and warrant that you meet the eligibility requirements.
Account Registration and Security
• To use the app, you will need to verify your phone number. This is required for authentication and connecting with your contacts.
• Location sharing is a core feature of the app. While you can temporarily pause location sharing, the app requires location permission to function as intended.
• You have the right to:
- Pause location sharing temporarily
- Choose which contacts can see your location
- Delete your account and data
- Export your data
• You can delete your account and associated data at any time through the app settings.
• We implement industry-standard security measures to protect your data, including encryption in transit and at rest.
Description of the Service
Phonar provides a service to share locations between contacts. The App is provided on an "AS IS" and "AS AVAILABLE" basis. We reserve the right to modify, suspend, or discontinue any aspect of the App at any time without notice.
User Conduct and Responsibilities
• You agree to use the App only for lawful purposes and in accordance with these Terms.
• You agree not to engage in any behavior that could harm, disrupt, or abuse the App, its functionality, or its users.
• You are solely responsible for all content that you post, upload, or submit through the App. You grant us a non-exclusive, worldwide, royalty-free license to use, display, and reproduce such content.
Prohibited Activities
In connection with your use of the App, you agree not to:
• Post or transmit any content that is illegal, defamatory, abusive, or otherwise objectionable.
• Infringe the intellectual property or proprietary rights of others.
• Interfere with the operation of the App (e.g., by introducing viruses, spam, or other harmful code).
Intellectual Property Rights
All intellectual property rights in the App, including but not limited to text, graphics, user interfaces, visual interfaces, photographs, trademarks, and code, are owned by IslandDevs or its licensors. You agree not to copy, modify, distribute, or create derivative works based on our content without our prior consent.
Termination
We reserve the right, in our sole discretion, to suspend or terminate your account and access to the App at any time if you violate these Terms or for any other reason. Any termination of your account does not relieve you of any obligations incurred prior to the termination.
Disclaimers and Limitation of Liability
• The App is provided without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We do not guarantee that the App will be error-free, secure, or available at all times.
• In no event shall IslandDevs, its affiliates, directors, employees, or licensors be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the App.
Indemnification
You agree to indemnify and hold harmless IslandDevs and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the App or your violation of these Terms.
Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Effective Date" at the top of this document. Your continued use of the App after the posting of changes constitutes your acceptance of such changes.
Governing Law and Dispute Resolution
These Terms shall be governed by the laws of Cayman Islands. Any disputes arising from these Terms or your use of the App shall be resolved in the appropriate courts located in Cayman Islands.
